Deni Mathews Succesful at the Court of Appeal

Deni Mathews successfully appealed significant sentences imposed on two Romanian men convicted of credit card skimming offences in Dartmouth. The men had been caught in possession of sophisticated equipment used to obtain cards and pin numbers, the stolen details were subsequently used to withdraw cash. When sentenced the sentences incorporated a deterrent element, but the Court of Appeal were persuaded that such an approach was inappropriate given the widespread nature of such offences, and could not fairly represent a proper basis for sentencing outside the relevant guidelines. The appeal also explored issues as to whether the use of sophisticated equipment would always allow an offence itself to be described as sophisticated within the language of sentencing guidelines.

The successful appeals secured immediate release for both appellants.
