Charlotte Davies involved in a 4 day Employment Tribunal Hearing

Judgment has been reserved following a four day Employment Tribunal hearing, which included six hours of submissions, in the matter of James v Cornwall Council.

 

Charlotte Davies represented the Claimant, a social worker, who brings claims of disability discrimination and constructive dismissal. The Claimant was diagnosed as dyslexic and dyspraxic in March 2013 following which she asserts, inter alia, that the Respondent should not have performance managed her for a period of six months post receipt of new assistive software and training. The Respondent denies such a period was advised or agreed.

 

The Claimant brings claims under s.13 EA 2010 (direct discrimination), s.15 (discrimination arising ), s.20 (failure to make reasonable adjustments) and s.27 (victimisation), including two acts of post-termination victimisation.

 

The decision of the Tribunal, chaired by Judge Carstairs, is awaited.
