Deni Mathews has succeeded in obtaining leave to seek a full judicial review of an element of UK Government foreign policy. Albania is a country with a long history of violent blood feuds between families. The feuds are in some instances centuries old. Published UK Government guidance asserts that the Albanian government has now put in place a level of internal protection for victims of such offences, such that no victims could make out a claim for the need for internal protection. Deni has been granted leave to challenge such, “certification” of a claim for asylum or humanitarian protection by identifying contradictions within the published guidance, and arguing that application of a flawed policy inevitably represents a failure to properly consider an individual claim on its merits, putting the Government in breach of international treaty obligations.
